There is always a danger—I am guilty of the tendency myself when we are drafting a bill—that once we get the short title, we get out the pail and spade and tip everything in our in-tray into a specific bill.
I sympathise with the point that Bill Aitken has made. We are getting just one side of the story. This is not a new situation, as I remember that 15 or 20 years ago there was a problem with getting replacements for wardens—it is not always easy to fill the posts.
However, there is a fundamental flaw in the suggestion that because a case does not get junior counsel, the person involved will get poorer representation.
We have always talked about trying to obtain parity on an average basis, so I think that no one will dispute the fact that some individuals may get huge amounts while some may get low amounts.
