Subordinate Legislation Considered by the Delegated Powers and Law Reform Committee on 2 March 2021
The Health and Care Professions Council’s (“HCPC”) earlier COVID-19 order (S.I.2021/27) was laid in both the Scottish and UK Parliaments on 14 January 2021, however, the Delegated Powers and Law Reform Committee noted that S.I. 2021/27, in amending HCPC rules, omitted a provision that defines the date a document is treated as being sent.

Management of Offenders (Scotland) Bill at Stage 1 - Annex
The purpose of this default disclosure period is to ensure that any new criminal court disposal that is created but not included in the 1974 Act, for whatever reason, will have a disclosure period of 12 months, (6 months if under 18 at date of conviction. This means that the individual receiving such a disposal will be protected under the 1974 Act from having to disclose it after 12 months, (6 months if under 18 at date of conviction).
