I am sure that he will protest that the exemption is merely to allow customers to test cigars before buying them. However, as Stewart Maxwell has pointed out, it would be simple for a customer to step outside the shop to test the product.

That worries me.Andrew Ryder of the Gypsy and Traveller law reform coalition told us in his evidence to the committee that there was broad support in England—including from the CRE, the Local Government Association and the Association of Chief Police Officers—for a statutory duty on councils to provide sites and for a forthcoming legal obligation on councils to identify land that Travellers can buy. Does the Executive have any plans to introduce such a duty in Scotland, perhaps through the forthcoming planning bill?
