Domestic Abuse (Scotland) Bill: Consideration prior to Stage 3 - Impact of domestic abuse on children
We consider it may be difficult for a court to determine, in an individual case, to what extent an offence is aggravated, and therefore what account to take of this when sentencing the offender, if the aggravation relates not to what the perpetrator did or what the child witnessed first-hand, but to the family circumstances of the victim, or the effect that the behaviour had on the victim's (or the perpetrator's) children.
