Caution 5 Finding of caution 5 (1) The court, when appointing a person as a judicial factor, may require the person to find caution for the performance of that person’s functions as judicial factor. (2) The court may impose a requirement under subsection (1) only where it considers that exceptional circumstances make it reasonable to do so. (3) The Accountant— 10 (a) must specify the amount of caution to be found, and 1 (b) may at any time while the judicial factory subsists— (i) require the person to find new, or additional, caution, or (ii) authorise a reduction in the amount of caution to be found.
