For a non-entitled cohabitant, an application must be made to the court to have occupancy rights declared. If a person living in a property does not have those statutory occupancy rights or another legal right to occupy, the Shelter Scotland website says that tenants can use self-help measures to make that person leave the property, for example by changing the locks and not letting the person back in.
