It has been estimated that by getting Scotland more active we would increase average life expectancy by more than a year, based on our current levels of activity.
That would be a purely practical way for it to get on with business. It is probably an example of what we discussed previously, convener, about how we get there.
The benefit of having a judge decision as opposed to a jury decision—as I say, I am in favour of corporate decisions—is that you get a reasoned decision. You will not get that from a specialist sexual offences court.

The unemployment rate was 3.1 per cent, down 0.6 percentage points since December 2019 to February 2020 (pre-pandemic) and the inactivity rate was 21.0 per cent, down 0.6 percentage points since pre-pandemic.
Following earlier research by the Scottish Liberal Democrats, the Inspectorate of Prosecution in Scotland has concluded that FAIs are characterised by “lengthy intervals of unexplained delays” and “periods of inactivity”, which “have the potential to devalue the purpose of the FAI.”
I want to focus on the aspects of the bill that will create criminal offences, and specifically on the approach of prohibiting behaviours rather than specific activities. I would like to get your perspective on that and your sense of how that would work.
Clause 18, subsection (2) defines “Scottish licensable marine activity” as an activity listed in section 21(1) of the Marine Scotland Act 2010 (as that section has effect from time to time).
