The investigation is then passed on to the procurator fiscal, and when there is an allegation of death by dangerous driving that case will be precognosced—investigated by the fiscals—and a decision will be made by the Crown counsel.I fully appreciate the anxieties over deaths resulting from road traffic accidents; however, we work within the existing law, which is reserved to Westminster. We must live with that. The problem is not unique to Scotland; other jurisdictions have to deal with the issue of selecting the right charge when deaths occur as a result of a road traffic accident.
