SP Bill 50A Session 6 (2025) 2 Schools (Residential Outdoor Education) (Scotland) Bill (2) Education authorities and the managers of grant-aided schools must, in carrying out their duties under section 6A of this Act, have regard to the guidance issued under subsection (1). (3) The Scottish Ministers must issue the guidance required by subsection (1) 5 within 3 months of this section coming into force. (4) Guidance issued under subsection (1) must in particular include provision about— (a) the nature and content of residential outdoor education, (b) the standard to which residential outdoor education must be provided, 10 (c) how education authorities and the managers of grant-aided schools should 1 assess whether residential outdoor education is suitable to a pupil’s age, ability, aptitude and any additional support needs, (d) the costs that it would be reasonable for education authorities and the managers of grant-aided schools to incur in providing or securing the 15 provision of residential outdoor education, (da) the funding sources available to schools, parents and carers to support the delivery of, and attendance at, residential outdoor education suitable to a pupil’s age, ability, aptitude and any additional support needs, including how self-directed support may be used, 20 (e) the voluntary nature of participation by pupils in residential outdoor education, (f) the year groups of pupils within primary and secondary education to whom the residential outdoor education is to be provided, (g) the manner in which education authorities and the managers of 25 grant-aided schools should engage with any inspections under section 66 of this Act in relation to their duties under section 6A of this Act, and (i) the delivery of residential outdoor education by means of the Gaelic language to pupils who receive Gaelic medium education. 30 (4A) For the purposes of subsection (4)(da), “self-directed support” is to be construed in accordance with section 4 of the Social Care (Self-directed Support) (Scotland) Act 2013. (5) The Scottish Ministers may from time to time revise guidance published by them under subsection (1) and must publish the revised guidance. 35 (6) Subsections (2) and (4) apply to any revised guidance published under subsection (5). (7) Before preparing any guidance or revised guidance under this section, the Scottish Ministers must consult the following persons— (a) each education authority, 40 (b) the managers of each grant-aided school, (ba) representatives from recognised trade unions which represent the interests of persons employed in— (i) public schools, (ii) grant-aided schools, 3 Schools (Residential Outdoor Education) (Scotland) Bill (c) such parents of pupils in respect of whom the duties under section 6A of this Act apply as the Scottish Ministers think appropriate, (d) such persons involved in the operation of premises or other facilities used to provide residential outdoor education, or organisations 5 representing such persons, as the Scottish Ministers think appropriate, (e) such other voluntary organisations as the Scottish Ministers think appropriate, and (f) any other persons that the Scottish Ministers think appropriate. (8) For the purposes of subsection (7)(ba), “trade union” has the meaning given 10 by section 1 of the Trade Union and Labour Relations (Consolidation) Act 1 1992 and “recognised”, in relation to a trade union, is to be construed in accordance with section 178(3) of that Act.”. 2 Education authorities’ arrangements with independent schools (1) The Education (Scotland) Act 1980 is amended as follows. 15 (2) After section 49(2ZA) insert— “(2ZB) Before exercising the power conferred by subsection (2)(b) in respect of a person attending an independent school, an education authority must have regard to the matter mentioned in section 50B.”.
