Building on the example of the independence referendum, The Scottish Elections (Reduction of Voting Age) Bill will extend the right to vote in Scottish Parliament and local government elections to all 16 and 17 year olds.
Section 7 – Statutory Conditions: Entitlement to Fixed Equipment
The statutory conditions governing crofting tenancies are set out in Schedule 2 of the Crofters (Scotland) Act 1993. These conditions set out the tenant crofter's specific obligations to the landlord.
Section 15 - Notice of muirburn activity
As in the Hill Farming Act 1946, the Bill provides that a person who intends to make muirburn must give notice in writing to the landowner of the proposed site (if different from the person making the muirburn) and any occupier of land within 1km of the proposed site.
Recommendation
The Committee accepts that the commencement regulations are subject only to the default laying requirement under section 30 of the Interpretation and Legislative Reform (Scotland) Act 2010, which is the normal parliamentary procedure for commencement regulations.
When questioned on the UK Government's commitment to consult on extending the sunset period, the Cabinet Secretary confirmed that the Scottish Government's position is that it would like the Bill to contain a requirement to consult with the Scottish Government on an extension.
Under the Verity House Agreement, local government funding in Scotland will not be ring-fenced or directed, unless there is a clear joint understanding to do so.
