Stage 1 report on the Land Reform (Scotland) Bill - Thresholds
Some were supportive of the proposed 1000 hectare thresholdiWritten submissions of John Muir Trust, Centre for Local Economic Strategies, Scottish Environment LINK, Naomi Beingessner, others considered it too high,iWritten submissions of The Common Weal, Scottish Crofting Federation, Community Land Scotland, Peter Peacock others too low.iWritten submissions of MacRobert Trust, RH Gladstone and co Those who favoured a lower threshold often coalesced around 500 hectares.iWritten submissions of Scottish Crofting Federation, Borders Community Action, Jimmy Reid Foundation, Development Trusts Association Scotland CLS calculated that the 500 hectare threshold would likely impact 17 transactions a year and stated that this “cannot be regarded as being an excessive number”.Written submission of Community Land Scotland

As set out previously, CLS proposed that the term “significant landholdings” should be used instead of “large landholdings” and the following criteria applied:
land of 500 hectares or more
land that comprises 25% of a permanently inhabited island
a “site of community significance” – land that a designated public body can agree is of significance to any applying community.Written submission of Community Land Scotland
This could bring some urban and peri-urban communities within the scope of the Bill.

P ART 3 M ISCELLANEOUS PROVISION RELATING TO START , END OR LENGTH OF LEASE 20 Default duration and date of entry 26 Duration of lease and date of entry in absence of agreement (1) This section applies where the tenant under a lease to which this Act applies has entered into possession of the subjects of the lease. (2) Where the lease does not provide for the period of the lease (expressly or by implication), 25 or any period so provided for cannot be established, that period is one year beginning with the date of entry under the lease. (3) Subsections (4) and (5) apply where the lease does not provide for the date of entry (expressly or by implication) or any date so provided for cannot be established. (4) The date of entry under the lease is to be treated as if it were— 30 (a) the date on which the tenant entered into possession of the subjects of the lease, (b) if that date cannot be established, the date on which the lease was granted, or (c) if that date cannot be established, 28 May in the earliest year in respect of which rent was paid under the lease. (5) A party to the lease may apply to the sheriff to determine the date of entry under the 35 lease. (6) Where, in any proceedings before a court or tribunal (whether under subsection (5) or otherwise), the court or tribunal determines the date of entry under the lease, the court or tribunal may order that the lease is to be endorsed with the date of entry. 18 Leases (Automatic Continuation etc.)
