Power to reimburse costs 1 Power for Scottish Ministers to reimburse costs relating to the removal of 5 transvaginal mesh (1) The Scottish Ministers may make a scheme for the making of payments by them reimbursing costs incurred in connection with qualifying mesh removal surgery. (2) “Mesh removal surgery” is surgery a principal purpose of which is to wholly or partially remove from a person’s body synthetic mesh which was originally implanted 10 transvaginally (that is, by means of insertion through the person’s vaginal wall) for the 1 purpose of treating stress urinary incontinence or pelvic organ prolapse. (3) Mesh removal surgery is “qualifying” mesh removal surgery if it was arranged— (a) other than by a health board, (b) in relation to a person who was ordinarily resident in Scotland at (either or both)— 15 (i) the time the mesh removal surgery was arranged, (ii) the time of implantation of any of the mesh which it is the purpose of the mesh removal surgery to wholly or partially remove, and (c) before a date specified in the scheme, which can be no earlier than the day of Royal Assent. 20 (4) The following are costs incurred in connection with qualifying mesh removal surgery— (a) the cost of the qualifying mesh removal surgery, as charged to or in respect of the person who underwent the surgery, (b) reasonable costs incurred by— (i) that person, and 25 (ii) one other person who was supporting that person, in travelling to and from the place where the surgery took place, SP Bill 3A Session 6 (2021) 2 Transvaginal Mesh Removal (Cost Reimbursement) (Scotland) Bill (c) reasonable accommodation and subsistence costs incurred by those persons while at that place, and (d) any other costs specified as such in the scheme. (5) In subsection (3), “health board” means a board constituted under section 2(1)(a) of the 5 National Health Service (Scotland) Act 1978. 2 Further provision about scheme (1) A scheme under section 1 may in particular make provision— (a) requiring an application to be made for a payment under the scheme (a “reimbursement payment”), 10 (b) requiring applications to be made before a date specified in the scheme, 1 (c) about the persons by whom applications may be made, (d) about how applications may be made, (e) about information and evidence to be provided with, or in relation to, applications, (f) about factors that may be taken into account...

Circular economy strategy 5 1 Circular economy strategy (1) The Scottish Ministers must prepare a circular economy strategy. (2) The circular economy strategy— (a) must set out the Scottish Ministers’ objectives relating to developing a circular economy, 10 (b) must set out the Scottish Ministers’ plans for meeting those objectives (including 1 priorities for action), (c) must set out arrangements for monitoring progress towards meeting the objectives, (d) may set out any other matters relating to developing a circular economy that the Scottish Ministers consider should be included. 15 (3) In preparing the circular economy strategy, the Scottish Ministers must have regard to the desirability of the economy being one in which— (a) processes for the production and distribution of goods, products and materials are designed so as to reduce their consumption and their whole life-cycle carbon emissions, 20 (b) the delivery of services is designed so as to reduce the consumption and whole life-cycle carbon emissions of goods, products and materials, (c) goods, products and materials are kept in use for as long as possible to reduce their consumption, their whole life-cycle carbon emissions and their impacts on the environment, 25 (d) the maximum value is extracted from goods, products and materials by the persons using them, (e) goods, products and materials are recovered or, where appropriate, regenerated at the end of their useful life, (f) waste is managed in Scotland if it is appropriate to do so, SP Bill 31B Session 6 (2024) 2 Circular Economy (Scotland) Bill (g) due diligence in relation to environmental protection and human rights is exercised in supply chains. (3A) In preparing the circular economy strategy, the Scottish Ministers must have regard to the following waste hierarchy— 5 (a) waste prevention, (b) preparing for re-use, (c) recycling, (d) other recovery, including energy recovery, (e) disposal. 10 (3B) In preparing the circular economy strategy, the Scottish Ministers must have regard to 1 the just transition principles set out in section 35C of the Climate Change (Scotland) Act 2009. (3C) In preparing the circular economy strategy, the Scottish Ministers must have regard to the desirability of encouraging the kinds of behavioural changes, and public education 15 and skills, which would be required to meet the objectives set out in the strategy. (3D) In preparing the circular economy strategy, the Scottish Ministers must have regard to the circular economy targets imposed by regulations made under section 6. (3E) In preparing the circular economy strategy, the Scottish Ministers must have regard to the role that re-use, refill and take-back schemes have in contributing to the development 20 of a circular economy. (3F) In preparing the circular economy strategy, the Scottish Ministers must have regard to the importance of consumer and workplace safety. (3G) In preparing the circular economy strategy, the Scottish Ministers must have regard to the potential international impacts of their circular economy policies. 25 (3H) In preparing the circular economy strategy, the Scottish Ministers must have regard to— (a) encouraging equal opportunities (within the meaning of Section L2 of Part 2 of schedule 5 of the Scotland Act 1998), and (b) furthering the reduction of inequalities of outcome which result from socio-economic disadvantage. 30 (4) In considering priorities for action under subsection (2)(b), the Scottish Ministers must have particular regard to sectors and systems most likely to contribute to developing a circular economy, with reference to the following criteria for identifying those sectors and systems— (a) achieving the net-zero emissions target set out in section A1 of the Climate Change 35 (Scotland) Act 2009, (b) reducing the consumption and whole life-cycle carbon emissions of goods, products and materials, (c) maximising the value of the circular economy in Scotland, (d) considering the wider environmental impact of particular sectors and systems. 40 (5) The circular economy strategy must be prepared with a view to achieving consistency, so far as practicable, between the objectives and plans set out in the strategy and— (a) the climate change plan prepared under section 35 of the Climate Change (Scotland) Act 2009, 3 Circular Economy (Scotland) Bill (b) the environmental policy strategy prepared under section 47 of the UK Withdrawal from the European Union (Continuity) (Scotland) Act 2021, and (c) any other strategy or plan which the Scottish Ministers consider to be relevant. (6) The Scottish Ministers must have regard to the circular economy strategy in making 5 policies (including proposals for legislation). (7) In subsection (6), making policies includes developing, adopting and revising policies. 2 Consultation on strategy In preparing the circular economy strategy, the Scottish Ministers must publish a draft strategy and consult— 10 (za) such persons as they consider may have an interest in the strategy, including public 1 sector, private sector, charitable and international organisations, (a) such other persons as they consider appropriate, and (b) the general public. 3 Publication and laying...
