Given that the Government owns CalMac, surely it could instruct the company in that capacity and give it a strategic undertaking that would take those factors into account. Indeed it could. I have been associated with Highlands and Islands Enterprise for 10 years.
Let us remember, too, that in relation to other organisations—such as Dial-a-bus, which I used as an example—the Scottish Executive and the appropriate minister will be accountable and covered by the freedom of information regime.
Perhaps my wording of amendment 112 was weaker than it could have been, given that it left the courts "taking into account". Perhaps I should have said that courts should have to take into account the agreement and accept its terms.
