P ART 2A V ICTIMS ’ RIGHT TO RECEIVE INFORMATION 30 29A Single victim notification system (1) The Criminal Justice (Scotland) Act 2003 is amended by subsections (2) to (4). (2) In section 16 (victim’s right to receive information concerning release etc. of offender)— (a) in subsection (1)— (i) in the opening words, the words “Subject to subsection (2),” are repealed, 35 (ii) in paragraph (a), the words “for a period of 18 months or more” are repealed, (iii) paragraph (b) is repealed, (b) subsection (4)(a) is repealed. 16 Victims, Witnesses, and Justice Reform (Scotland) Bill Part 2A—Victims’ right to receive information (3) In section 17 (release on licence: right of victim to receive information and make representations), subsection (12)(b), and the word “or” immediately preceding it, are repealed. (4) In section 17ZA (release on licence: provision of information to person supporting 5 victim), subsection (5)(b) is repealed. (5) The 2014 Act is amended by subsections (6) to (9). (6) Section 27A (notification of victims in relation to release etc. of short term prisoners) is repealed. Planning (Scotland) Bill 7 Part 1—Development planning (4) For the purposes of the consultation required by subsection (3), the Scottish Ministers must— (a) lay before the Scottish Parliament a copy of the proposed draft framework, 5 (b) send a copy of the proposed draft framework to any person to be consulted under subsection (3), (c) publish the proposed draft framework and make it available to the public at large in such manner as they consider appropriate, and (d) have regard to any representations about the proposed draft framework 10 that are made to them within no more than 120 days of the date on which the copy of the proposed draft framework is laid before the Parliament under paragraph (a). (5) In calculating any period of no more than 120 days for the purposes of subsection (4)(c), no account is to be taken of any time during which the 15 Parliament is dissolved or is in recess for more than 4 days. (6) If, as a result of any consultation required by subsection (3), it appears to the Scottish Ministers that it is appropriate to change the whole or any part of their proposals, they must undertake such further consultation with respect to the changes as they consider appropriate. 20 (7) The explanatory document referred to in subsection (2)(b) must set out— (a) the consultation undertaken in accordance with subsections (3) and (6), (b) a summary of any representations received as a result of the consultation, and (c) the changes (if any) made to the proposed draft framework as a result of 25 those representations. (8) Where a person making representation in response to consultation under this section has not consented to the disclosure of the representations, the Scottish Ministers must not disclose them. (9) If information in representations made by a person in response to consultation 30 under subsections (3) and (6) relates to another person, the Scottish Ministers must not disclose that information if or to the extent that— (a) it appears to the Scottish Ministers that the disclosure of that information could adversely affect the interests of that other person, and (b) the Scottish Ministers have been unable to obtain the consent of that 35 other person to the disclosure. (10) Subsections (8) and (9) do not affect any disclosure that is requested by, and made to, a committee of the Parliament charged with reporting on the proposed draft framework.
