However, my experience in the tribunal is that when, for example, a headteacher is asked to comment on why they are not complying with a section in the statutory code of practice under the 2004 act, they will be unaware that the code exists.

The additional threshold of 10% across three constituencies is in recognition that regional MSPs are required under the Code of Conduct to demonstrate that they work across numerous constituencies as opposed to focussing on one particular constituency.
