In her evidence, the Minister for Public Health and Women's Health told the Committee that, should the Bill be passed, the Scottish Government plan to bring the Act fully into force by 6 September 2027 (the same date that the related licensing scheme under the Civic Government (Scotland) Act 1982 will become operable).

In the Minister's letter to the Committee, dated 15 May 2025, she explained that it was not appropriate to make a comparison with the statutory offence of breach of the peace as the section 38 offence is not an example of common law being directly replaced by a statutory offence.
Interviewee O2 also noted that they did not think the work had achieved much substantially, although they suggested it would have given the Scottish Government a bit of a nudge. However, to date the committee is not aware of progress being made in this area (Interview O2).
