We are in discussions with colleagues about a bill that might be suitable, although other considerations have to be taken into account in doing that. If it is at all possible, we intend to legislate next year, but that will depend on our being able to get approval for a suitable bill.

However, there is power in the Mental Health (Care and Treatment) (Scotland) Bill to amend legislation to ensure that the new regime is taken account of. We will be able to amend the Sexual Offences Bill and to use the order-making power to ensure that it takes account of the new regime.
