The 1997 guidelines on interpreting state aid rules per the maritime cabotage regulation state:"for public service contracts to be consistent with the common market and not to constitute State aid, the commission expects public tenders to be made".Those guidelines have now been scrapped and replaced with the 2004 guidelines, which make no reference to tendering. The later guidelines were produced following the Altmark case, which acknowledged that bus services in Bavaria did not require to be put out to tender.
