In strict legal terms, TUPE only applies to “economic entities”, which means “administrative 8 functions of public authorities” can be a grey area. A UK Cabinet Office Code (“CoSOP”) fills this gap, and requires that the “principles of TUPE should be followed” notwithstanding.
