Section 5 - Consideration of time spent on electronically monitored bail in sentencing Section 5 of the Bill would require a court, when imposing a custodial sentence, to have regard to any period the person spent on bail subject to an electronically monitored curfew condition. This could be pre-trial bail or bail whilst awaiting sentence.
