The Referendums (Scotland) Bill provides for Ministers, by regulations (subordinate legislation), to hold a referendum with the date, wording of the question(s), form of ballot paper, and the referendum period to be set out in regulations.
The European Union Referendum (Conduct) Regulations 2016; the European Union Referendum (Date of Referendum) Regulations 2016, and the European Union Referendum (Voter Registration) Regulations 2016 also formed part of the bespoke package of legislation to govern the referendum.
The EU TSE Regulation has been updated in recent years and several parts of the 2010 Regulations are out of date.
The instrument is made under the negative procedure and comes into force on 23 May 2019.
1.2.4 Advance directives and statements
Patients with capacity can make ‘directives’ to refuse treatment at a later date when they have lost capacity and cannot make decisions.
Any local authority not intending to agree the offer, and associated terms, must notify the Scottish Government by 18 January 2019. This is also the date by which any discrepancies identified by local authorities or COSLA should be raised with the Scottish Government.

The Committee nevertheless requests that the Scottish Government provide updates to both it and the relevant lead committee about the reasons for any delay as well as the anticipated laying dates to aid future planning.

In its letter to the Presiding Officer dated 23 January 2018, the DPLR Committee stated that accordingly, they do “not think it is necessary to pursue an amendment to establish a sifting committee for the Scottish Parliament.”
