Minister for Business, Trade, Tourism and Enterprise Ivan McKee MSP T: 0300 244 4000 E: [email protected] Kenneth Gibson Convener of Finance and Public Administration Committee Scottish Parliament Email: [email protected] ___ 8 August 2022 Dear Convener, NOTIFICATION OF EXPENDITURE WITHOUT STATUTORY AUTHORITY The Scottish Ministers, through their Finance and Economy portfolio, will provide funding of £15,000 from the budget for financial year 2022 to 2023 in order to fund the appointment of a Shadow Scottish Pubs Code...
Background
The Tied Pubs (Scotland) Act 2021 established the Scottish Pubs Code Adjudicator to regulate the relationship between tied pub tenants and landlords through the introduction of a statutory Scottish Pubs Code.
Provisions of the Bill
The bill was split into two parts:
Part 1 requires Scottish Ministers to make a code of practice ('the Code') in relation to buying, selling and giving away puppies and dogs as pets.

Many stakeholders argued that it was appropriate for this to be detailed in the Code of Practice on Deer Management (the Deer Code) rather than on the face of the Bill.

The funding model in the bill would mean that pub-owning companies bear the majority of the ongoing costs of the Scottish pub code adjudicator's office. These costs will be met by an annual levy on those businesses covered by the code, and follows the model used in the 2015 Act.
