Coronavirus (Recovery and Reform) (Scotland) Bill: Criminal Justice, Courts and Legal Aid - Background
Regarding criminal confiscation, section 99 of the Proceeds of Crime Act 2002 generally allows the court to postpone relevant proceedings for up to two years after the date of conviction. The normal (pre-pandemic) rules state this two-year limit does not apply if there are exceptional circumstances.
