Liability
The Committee notes the points raised by legal stakeholders in relation to Bill's current approach towards establishing liability, and in particular how this may make present challenges to the Redress Scotland panel in verifying whether abuse took place.
It includes maintaining the Regeneration Capital Grant Fund as well as capital funding that will be allocated to each of Scotland’s 32 local authorities to invest locally in line with the above shared aspirations.
The absence of these capital income streams causes the biggest threat to the closure of Scotland’s Residential Centres. The Bill will potentially need to consider Capital funding separately to the pupil allocation that will cover revenue costs.
