Accepted practice is that new powers to make subordinate legislation should be proposed in a bill and receive the full parliamentary scrutiny involved in a bill process.
The specific issues that are raised in PE1748 were not considered during scrutiny of the Planning (Scotland) Bill, or during the planning reform process.
As I have said, instead of shying away from that and suggesting that we need to start dismantling things, we think that the whole cut-and-paste exercise of the withdrawal bill is the right sort of starting point for us.
We would need to assess if this approach would be right for Scotland. Introducing a similar measure here might have the adverse impact of driving forced marriages even further underground.
