(2) In this section, “relevant education provider” means a person or body which— 10 (a) provides higher education or further education, and 1 (b) carries on activities in Scotland or in another part of the United Kingdom. For Women Scotland v The Scottish Ministers from the Equality Network and Scottish Trans 24 April 20
This is particularly true given that trans people make up only 0.44% of the Scottish population according to the recent 2022 census data. We note that this assessment is absent from the UKSC’s judgment and no evidence was put forward to suggest that trans women pose any threat to women’s safety in single-sex spaces.
