(2) In this section, “relevant education provider” means a person or body which— 10 (a) provides higher education or further education, and 1 (b) carries on activities in Scotland or in another part of the United Kingdom. (2A) A relevant education provider is to be treated as having been designated for the purpose of this section if— (a) the Secretary of State has designated the provider under section 84 of 15 the Higher Education and Research Act 2017, (b) the Welsh Ministers have designated the provider under section 83 of the Tertiary Education and Research (Wales) Act 2022...
