The approach taken in the Bill is in line with the approach already in place for local government accounts, as set out by the Chartered Institute of Public Finance and Accountancy (CIPFA) in their Code of Practice on Local Authority Accounting.
I can confirm that it is our intention to lay before Parliament draft orders to continue minimum unit pricing beyond 30 April 2024 and to set the price per unit at 65p.
As previously noted, this is an extraordinary update rather than a new CCP, as part of the regular 5-year cycle, therefore the laying, and scrutiny of this draft CCPu does not fall within the purview of the Act.
The Scottish Government has chosen to lay this instrument under the negative procedure and has categorised it as Low in terms of significance under the SSI Protocol.
Justice Committee scrutiny
The Committee noted the time that this Committee has had for this instrument has been surprisingly short. This SI has a laying date of 10 December. The reason for not allowing 28 days for Scottish Parliamentary scrutiny is that “drafting issues emerged late”.
Recommendation
The Committee accepts that the commencement regulations are subject only to the default laying requirement under section 30 of the Interpretation and Legislative Reform (Scotland) Act 2010, which is the normal parliamentary procedure for commencement regulations.
