Mr Gallie has made great play of the effect of the ECHR, as have many other Conservative MSPs. Amendments relating to the ECHR that read across to the Human Rights Act 1998 were introduced at quite a late stage during the passage of what became the Scotland Act 1998.

He has issued a consultation paper, in which I understand that he makes it clear that he has an open mind on the position and on the proposals contained in the paper, and that he is inviting comment and consultation.
