Legislative Consent Memorandum: delegated powers relevant to Scotland in the Police, Crime, Sentencing and Courts Bill - Review of powers conferred on Scottish Ministers

Section 9(2) and 9(3) of the 2019 Act currently require OPOs to be served by the Secretary of State if they are made in England, Wales or Northern Ireland or by the Lord Advocate if they are made in Scotland. Paragraph 4(5) of schedule 5 of the Bill inserts a new section 9(5) of the 2019 Act (restrictions on service of order) and paragraph 5(3) of schedule 5 of the Bill inserts a new section 14(6) of the 2019 Act (means of service).
