From my simplistic perspective, the simplest route is probably the best one: to dispose of the consent requirement in the 2009 order and to dispense with part 2 of the bill.

The instruments that member states use and the ways in which they are used vary enormously. We are not best placed to say what is best practice, except to set out fairly basic guidelines on transparency and availability of information, so that people can respond.
