Regulation 17(2) of the instrument amends the Road Works (Reinstatement)(Scotland) Regulations 1992 at regulation 2(1) to provide that “the Code means the code of practice entitled “Specification for the Reinstatement of Openings in Roads” approved by the Scottish Ministers in February 2019 as revised and reissued from time to time” thereby replacing the earlier Code dated October 2003.
Scottish Ministers must consult on the code in preparing it, explicitly including local authorities and SEPA, and must lay a draft code in the Scottish Parliament for a minimum period of 40 days before its completion (with no account to be taken of time when Parliament is dissolved or in recess for more than 4 days)....
