I also agree with the view of the Law Society of Scotland, that the existing common law provides sufficient protection to workers who provide a service to the public, as it takes account of aggravating circumstances. The principle of an independent judiciary means that sheriffs and judges have the flexibility to take various factors into account when deciding a sentence.
