There has been no material change to the legislation that would require a re-issue of the code, however, the Scottish Government has taken the opportunity to strengthen the code, which makes more comprehensive and enhanced guidance available to proper persons.
The Committee welcomes the provisions in the Land Reform (Scotland) Act 2016 in relation to the Code of Practice but is concerned that the Code has been insufficient in influencing all DMGs.
We also recognise the importance of accountability to Parliament on the Code which is why this amendment specifies that the Code is to be laid before Parliament.

As the muirburn code would be central to the muirburn licensing scheme, the Committee believes that further information about the updated muirburn code would inform the Parliament’s consideration of the Bill.

In one case the Committee found that there had been a breach of the Code and wrote to the Co-Conveners of the Group to remind them of the obligation to comply with the requirements of the Code of Conduct.
