Age of Criminal Responsibility (Scotland) Bill - The Bill

As outlined above, until 2011 it was possible for a child over the age of eight to be prosecuted in a Scottish court. Since then, it has remained possible for a child aged eight to 11 to be referred to a children's hearing on the offence ground.
