Scottish Biometrics Commissioner Bill - The Bill
The Bill enables the Commissioner to apply to the Court of Session where any person who has been served with an information notice:
refuses or fails to comply with the requirement specified in the notice
refuses or fails to answer questions asked by the Commissioner
alters, suppresses, conceals or destroys any information that they have been asked to produce.
There is an exemption where there is a “reasonable excuse” for having done any of these things.

there is an anxiety about how those approaches rub up against each other, the impact on producers in different parts of the United Kingdom and whether there could be claims of unfair competition or subsidy regimes disadvantaging others.
