A Scottish Government official confirmed that the points raised by the Law Society had been considered before finalising the code of practice.
In relation to accessibility, the official explained that the Law Society's suggestion that the code should be available in different languages and formats had not been accepted because the code was for use primarily by constables.
Introduction
One of the functions of the Standards, Procedures and Public Appointments Committee, as set out in the Code of Conduct, is to consider information on whether Cross-Party Groups (CPGs) are complying with the Code of Conduct for MSPs ("the Code").
Compliance
The Code sets out that CPGs are formed and led by MSPs, with the Convener of a Group being primarily responsible for compliance with the Code.
Codes of Practice
Two Codes of Practice are issued under FOISA (by Scottish Ministers) to provide guidance to public authorities on responding to requests for information and associated matters (section 60 Code of Practice) and on records management (section 61 Code of Practice).1Freedom of Information (Scotland) Act. (2002).
We also recognise the importance of accountability to Parliament on the Code which is why this amendment specifies that the Code is to be laid before Parliament.
