How do you reconcile that view with the position of local authorities such as the City of Edinburgh Council, which has briefed MSPs that it intends to put out to contract all its home care services simply because the third sector will deliver those more cheaply?

It is probably the experience of most MSPs that a complaint must go through an agency's internal procedures before it is taken further—although in extremis, if a complaint was about the whole agency, someone might not bother with that process.

Sometimes, as Professor Kerley says, a nudge out the door is the answer if we want to improve services.As a councillor in a single-member ward, I used to get lots of complaints about Scottish Water, but the number that I receive as an MSP has dwindled to next to nothing even though I represent an area 10 to 15 times as big.

Amendment 73, in the name of the minister, is grouped with amendments 74, 75, 123 and 116. During stage 2, Robert Brown MSP lodged amendments that were intended to clarify that the remaining offence provisions in section 13 of the Criminal Law (Consolidation) (Scotland) Act 1995 are concerned solely with male prostitution.
