Paragraph 19 of Schedule 4 to the Bill expands the definition of “relevant client” to include persons detained under Part 1 of Schedule 3 to the Bill or section 41 of, or Schedule 7 to, the Terrorism Act 2000 (the “2000 Act”).
This point of view was supported in the written evidence to the Health and Sport Committee, by the Scottish Council on Human Bioethics which wrote:
This […] is a complete misrepresentation and misunderstanding of both the current system and of what is being proposed with the Bill. Indeed, Scotland already has a form of soft opt out system under the Human Tissue (Scotland) 2006 Act.
