Finally, the Scotland Act 1998 is defined within the Explanatory Note to the Order as “the 1998 Act.”
Taking these four factors into account, the Scottish Government is of the view that it is clear that the reference to “the 1998 Act” within article 4(1) of the Order can only be construed as a reference to the Scotland Act 1998.
