I see no reason to deviate from that process, especially as it is guaranteed that a copy of the report will be laid before the Parliament. Scottish ministers are accountable to the Parliament, and qualifications Scotland will be accountable to Scottish ministers, so it is right that ministers lay the submitted annual reports on the body’s behalf.

South of Scotland Enterprise Bill as amended at Stage 2

South of Scotland Enterprise Bill 5 12 Validity of things done The validity of anything done by South of Scotland Enterprise, its committees or sub- committees is not affected by— (a) a vacancy in membership or the office of chief executive, 5 (b) a defect in the appointment of a member or the chief executive, (c) the disqualification of a person as a member after appointment. Accountability 13 Accounts and audit South of Scotland Enterprise must— 10 (a) keep proper accounts and accounting records, (b) prepare in respect of each financial year a statement of accounts, and (c) send a copy of the statement to the Auditor General for Scotland for auditing. 14 Annual report (1) South of Scotland Enterprise must, after each financial year— 15 (a) prepare and publish a report of its activities during the year, and (b) send a copy of the report to the Scottish Ministers. (2) The Scottish Ministers are to lay before the Scottish Parliament a copy of each report received by them under subsection (1).
