My officials have advised me that the UK Government anticipates that a final decision from the Scottish Parliament on legislative consent is likely to be required by Autumn 2026, when the Bill is anticipated to be at the House of Lords stage, but this presents difficulties as it leaves limited opportunity for the Scottish Parliament’s view to be taken into account at such a late stage. The House of Lords stage is in effect the last point in the UK Parliament legislative process where the views of the Scottish Parliament can be taken into account fully.
