Any single-sex or separate‑sex provision must be made for a good reason, and organisations are advised to seek specialist legal advice where necessary rather than delaying action pending new guidance. Approval of a revised Code of Practice is unlikely, on its own, to resolve disputes over access to single‑sex services.

The DPLR Committee made no recommendations in relation to the instrument but, in relation to regulation 8, welcomed that the Scottish Government now intends to publish the Code of Practice in advance of the requirement coming into force, and highlighted to the lead committee its correspondence with the Scottish Government on this point.
