I am told that the project might be completed as early as next year, which would bring substantial benefits to Aberdeen and the north-east economy generally. Given that the V&A Dundee has been a transforming investment for the north-east’s attractiveness as a visitor destination, can the cabinet secretary confirm what investment the Scottish Government has made in the V&A?

However, the Law Society has pointed out that section 38 of the Criminal Justice and Licensing (Scotland) Act 2010 provides for cases to be brought on indictment, with sentences up to five years for threatening and abusive behaviour, and there is case law that backs that up. HM Advocate v McGinley is a breach of the peace on indictment.

As a matter of information, in respect of the evidence given by Dr Tickell, the relevant case on the public element of common-law breach of the peace is Harris v HMA, which was decided in 2009. I am sure that the cabinet secretary’s officials are aware of that, but they might wish to study it in greater detail.
