The code must be reviewed every five years and the Scottish Ministers must consult before making the first code and before reviewing and revising the code thereafter.
The Committee considers that this would enhance the opportunity for Parliamentary scrutiny of the Code, in line with the importance of the Code as set out above, by requiring both a pre-scrutiny Parliamentary consultation phase on the proposed draft Code, and a vote to approve the final draft Code before it could be issued.
Available options include— a) Dismiss the complaint if there has been no breach of the Code; b) Find that there has been a breach of the Code but that the breach does not warrant any of the actions listed under paragraphs c to e.
It will be available to people aged 16 or over, who are providing 35 or more hours of care a week to someone in receipt of a qualifying disability benefit and who meet certain criteria e.g. residency and type of education.
Section 36D relates to the preparation and revision of the Code. The Code must be consulted on with the organisations and representative bodies listed.
