UNCRC Act
The United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 (the UNCRC Act), came into force on 16 July 2024.
The ICO sent a further letter of clarification highlighting that it had an early-stage discussion with the Scottish Government on the widening access policy ambition in March 2024. The Bill was introduced by the UK Government in the House of Commons on 5 November 2024. It is a substantial Bill, currently made up of 8 parts (170 clauses) and 21 schedules.

Officials explained that there are the fines that are paid into the consolidated funds; there are the producer fees, which are charged from 2024 and are paid to the local authorities for running their systems; and there is a charge that SEPA and the other regulators can levy on producers to fund their operations.

Consequently, the provisions in the instrument will not fulfil the requirement to delay the changes until 1st January 2024 if they do not come into force on 30 September.
The Committee believes it is unacceptable for those parents and families affected to have to wait until 2024 for specialist baby loss units to be established.
In particular, it is noted that if the Bill achieves commencement by the end of 2019, then the next full Plan will be required at the latest by end 2024, which would align with the first specific year proposed by the Committee.
