The note that we received two weeks ago reminds me that the procedure that we are discussing would make the Parliament responsible for moulding and shaping an instrument, whereas the Scotland Act 1998 states that subordinate legislation should be made by Scottish ministers or by bodies that are responsible to the Parliament, not by the Parliament itself.
In any case, we are aware that the Parliament's first consolidation committee—which has been set up to deal with the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Bill—has recently published a stage 1 report that invites the Procedures Committee to examine a few issues about consolidation procedure.
We should do a trawl among our academic friends to find out what is happening, to ensure that we do not spend money on something that is already being done by universities in Scotland. There is scope for tying in our work with things that are already happening in other parts of society.
