It should be noted that, according to the terms of the ECHR, none of the human rights engaged by the Bill are absolute and all of these rights can be restricted on various grounds.
We feel the focus should be on impact and that all children who are adversely impacted by harm have the right to recovery support and protective measures.
We have also introduced mandatory debt advice prior to entering a statutory debt solution helping to ensure each person only enters a debt solution when it is right for them. As highlighted during the Committee’s evidence sessions, the Scottish Government has been carrying out two significant policy reviews covering Scotland’s debt recovery mechanisms (diligence) and our statutory debt solutions.
