The National Qualifications 2021 Group, made up of representatives from the Association of Directors of Education in Scotland (ADES), Colleges Scotland, Education Scotland, the Educational Institute of Scotland (EIS), School Leaders Scotland (SLS), the Scottish Council of Independent Schools (SCIS), Scottish Qualifications Authority (SQA), the Scottish Government, National Parent Forum of Scotland, and the Scottish Youth Parliament, met weekly to consider alternative certification arrangements for National Qualifications in the 2020–21 session.

The removal of these categories from the scope of the Trade Agreements does not prevent suppliers from these countries seeking to bid for these types of contracts but it does remove the ‘no less favourable’ treatment, including the rights to a domestic judicial remedy. Scottish Ministers, special advisers and the Permanent Secretary are covered by the terms of the Lobbying (Scotland) Act 2016.
