I do not want the work to be done and the consultation to take place on the publication code only for it not to be approved. The code will not work unless we do it properly and quickly replace what we currently have.

Section 17 - Delegation

The Committee recommends that the Scottish Government includes a complaint mechanism within the Bill, to enable the public to refer issues to the Scottish Biometrics Commissioner on the use of biometrics by Police Scotland and the SPA, or on their lack of compliance with the Code of Practice.
Section 37 of the 2006 Act also provides for the making of Animal Welfare codes by Scottish Ministers. The failure to comply with the provisions of an animal welfare code does not itself render a person liable to proceedings.
Of course, ministers have to be careful about engaging on particular developments because of the need to observe the ministerial code in taking decisions on such questions.
